Civil Litigation

  • Contractor-client brought suit on a debt owed and defendant counterclaimed alleging unfair or deceptive trade practices, breach of contract, and breach of warranty among other claims. After trial, a verdict entered for client on its original claim and for the client on the defendant’s counterclaims.

  • Injured client brought suit under the Uniform Commercial Code (U.C.C.) for breach of warrantee. Following trial, court ruled that the supplier of food was a “good” subject to U.C.C. contract law and allowed recovery of damages. The case was appealed and affirmed by the appellate court.

  • Clients paid a commission to be held in escrow pending closing of the transaction. The transaction fell through. The defendant wrongfully cashed the check for its fee. Suit was commenced and after trial a breach of contract and unfair or deceptive trade practices (M.G.L. c. 93A) were found. Multiple damages and attorney’s fees were awarded in clients’ favor. The case was settled while on appeal.

  • Contractor-client was charged with violations of the criminal law related to construction services. After conferring with prosecutor and providing records the case against the contractor-client was dismissed without costs.

  • Contractor brought suit against homeowner-client after contractor was declared in breach of the contract and prohibited from completing the contract. Homeowner-client counterclaimed for breach of contract and various defects in construction including unworkman like construction. After several days of trial, the case settled to the satisfaction of the client.
