The defense to the surrender consisted of utilization of a psychiatric report demonstrating substantial limitations and securing the assistance of a therapist who had treated the defendant in the past. The therapist appeared and offered expert testimony on the defendant's mental status, the non-desirability of incarceration, and the need for further treatment. After hearing, the court found no violation.
