Probation Surrender

  • Summary: The defendant who was at one time the victim of other crimes came before the Court on multiple occasions for new violations of the law. At the time of a new offenses, the defendant was on straight probation and a suspended sentence. The defense to the surrender consisted of utilization of a psychiatric report demonstrating substantial limitations and securing the assistance of a therapist who had treated the defendant in the past. The therapist appeared and offered expert testimony on the defendant's mental status, the non-desirability of incarceration, and the need for further treatment. After hearing, the court found no violation.
