Probation Surrender
- If an individual on probation is alleged by his probation officer to have violated the terms and conditions of his probation, the probation officer will commence a surrender proceeding. When one is placed on probation one agrees to abide by the terms and conditions of probation which include staying in contact with probation, informing them of your address, and committing no additional crimes. If you are alleged to have violated your probation, a hearing will be held in front of a judge without a jury where probation must prove it is more likely than not that you violated the terms and conditions of your probation. If this is proven, the court can revoke your probation and sentence you accordance with the law.
